Specific Terms of Use - Community Edition

YOU MUST READ THESE TERMS AND CONDITIONS (“Community Edition Terms”) BEFORE USING THE COMMUNITY EDITION (DEFINED BELOW). YOU SHOULD  REVIEW THESE TERMS IN ACCORDANCE WITH YOUR ORGANISATION’S POLICIES TO CONFIRM THAT YOUR PROVISION OF CONSENT IS WITHIN YOUR AUTHORITY AND CONSISTENT WITH YOUR ORGANISATION’S POLICIES REGARDING THE “COLLECTED DATA” (DEFINED BELOW). 

 

You agree to comply fully with the General Terms in addition to these Specific Terms of Use related to our Community Edition Terms. General Terms with all Specific Terms shall be referred to herein as the “Agreement”. In the event of a conflict or inconsistency between these General Terms and any Specific Terms, the Specific Terms control.

GENERAL DEFINITIONS

 

The following defined terms shall apply. All capitalised terms that are not defined herein shall have the meaning set forth in the General Terms.

 

“Community Edition”: Restricted version of the Malizen’s software allowing use of and access to certain elements and functionalities (but not all functionalities) of the software which is offered free of charge through the application app.malizen.com. The use of the Community Edition is subject to the provision of data by the Users (“Community User Data”). The Community Edition allows the analysis of event logs for cybersecurity threat detection purposes. 

 

“Malizen Models”: Malizen’s proprietary methods that use proprietary and other algorithms, modelling, data visualisation models, data quality processes, and adjustments to perform analysis from pools of data that may include publicly available data, third-party data and Community User Data (defined below).

“Community Users”: any users of the free Community Edition. 

“Users”: any user of Malizen’s products and/or services.

 

“Community User Data”: Any data that Community Users make available to us through any mechanism(s) that we make available in our Community Edition to receive such data. Community User data may include (but not limited to) event logs in the form of .csv and .json files. Community User Data also includes all processed data through our Community Edition and our Malizen Models such as but not limited, specific visualisation of Community User Data and reports.

 

GRANT OF LICENCE

 

Subject to your complete and ongoing compliance with this Agreement and our Policies, we grant to you, for the duration of your access and use, a worldwide, limited, personal, non-exclusive, non-sublicensable, non-transferable, revocable right and licence to access and use the Community Edition..  

 

YOUR USE OF DATA

 

You may access and/or use our Community Edition to make available to us your Community User Data and view, access, retrieve, and/or receive your Community User Data, including but not limited to visualisation elements, reports including and/or reflecting your Community User Data. 

You may choose to make your Community User Data available to others through shared investigations in the Community Edition or any other means (“Sharing”). The scope of such Sharing, and with whom, is up to you. You agree that, as between you and us, you are solely responsible and liable for such Sharing and that such Sharing shall be outside of the scope of the Agreement (including these Community Edition Terms) and our Policies.

Notwithstanding anything to the contrary in this Agreement:

(i) you acknowledge and agree that you are only authorised to access and/or use our Community Edition to access, retrieve, and/or use data that you have lawful rights to access, retrieve, use, and provide to us under these Community Edition Terms; 

(ii) you represent and warrant that the Community User Data you are providing us does not include any data or information relating to an identified or identifiable natural person other than you and/or your organisation; and 

(iii) you will notify us in writing promptly after discovering any breach in this Section.

 

OUR USE OF DATA 

 

You hereby grant to us a limited, exclusive, non-transferable, and revocable licence to: 

(i) use Community User Data in our Malizen Models to provide you the services associated with the Community Edition, and for the updating and improvements of our Malizen Models. 

(ii) store your User Data in our systems during the time of your access and use of our Community Edition. 

(iii) de-identify and/or anonymize your Community User Data and use such de-identified and/or anonymized data for any business purpose, including to provide, maintain, improve, and/or develop any of our current and/or future products and/or services. 

 

FOR THE AVOIDANCE OF DOUBT, WE WILL NEVER PROVIDE YOUR USER DATA TO OTHERS USERS.

 

Malizen ensures that the User's personal information is collected and processed in accordance with the French law n°78-17 of January 6, 1978 relating to data protection and European General Data Protection Regulation (GDPR).

 

Under the Data Protection Act of January 6, 1978, the User has the right to access, rectify, delete and oppose his personal data. The User exercises this right :

- by email to hello@malizen.com 

- by post to 2 rue de la Mabilais - 35000 Rennes - France.

ACCESS AND DELETION


A limited number of our employees (and those of third-party service providers authorised to carry out tasks on our behalf, as described in our Privacy Policy) may access and/or use your Community User Data in accordance with Sections 2 above. Upon your request, we will delete your Malizen account. Upon such deletion, we will immediately cease using your Community User Data. For the avoidance of doubt, you acknowledge and agree that we may retain any Community User Data that has already been included in the pool(s) of data used by Malizen Models. Additional information on our deletion practices can be found in our Privacy Policy. This Section shall survive any expiration or termination of the Agreement.
